The captain is responsible for logging all APA expenses, and you can view the expenses at any time during your boat charter. British tech magnate Mike Lynch and five other people were missing after their luxury sailing yacht sank during a freak storm off Sicily early Monday, Italy’s civil protection and authorities said. Lynch’s wife and 14 other people survived.

Lynch, who was  acquitted in June  in a big U.S. fraud trial, was among six people who remain unaccounted for after their chartered sailboat sank off Porticello, when a tornado over the water known as a waterspout struck the area overnight, said Salvo Cocina of Sicily’s civil protection agency.

One body was recovered, and police divers spent the day trying to reach the hull of the ship, which was resting at a depth of 50 meters (163 feet) off Porticello where it had been anchored, rescue authorities said. They returned to the site after 10 p.m. to see if it would be possible to search through the night, when weather conditions were expected to worsen, said Luca Cari, spokesman of the fire rescue service.

It had a crew of 10 people and 12 passengers, the Italian coast guard said. A sudden fierce storm had battered the area overnight, and struck the place precisely where the 56-meter (184-foot) British-flagged Bayesian had been moored.

“They were in the wrong place at the wrong time,” said Cocina, noting that another superyacht nearby wasn't as badly damaged and helped rescue some of the 15 survivors, who included Lynch's wife Angela Bacares.

The Bayesian was notable for its single 75-meter (246-feet) mast — one of the world’s tallest made of aluminum and which was lit up at night, just hours before it sank. Online charter sites listed it for rent for up to 195,000 euros (about $215,000) a week.

One of the survivors, identified as Charlotte Golunski, said she momentarily lost hold of her 1-year-old daughter Sofia in the water, but then managed to hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported, quoting the mother. The father, James Emsley, also survived, said Cocina.

Karsten Borner, the captain of the Sir Robert Baden Powell, said he had noticed the Bayesian nearby during the storm but after it calmed he saw a red flare and realized the ship had simply disappeared, ANSA and the Giornale di Sicilia newspaper reported. Borner said he and a crew member boarded their tender and found a lifeboat with 15 people, some of them injured, who they then took aboard and alerted the coast guard.

Eight of those rescued were hospitalized while the others were taken to a hotel. One body believed to be the cook was found near the wreck, but six others were unaccounted for and believed inside the hull, said Cari, the fire rescue spokesperson. The rescue operations, which were visible from shore, involved helicopters and rescue boats from the coast guard, fire rescue and civil protection service.

Fisherman Francesco Cefalu’ said he had seen a flare from shore at around 4:30 a.m. and immediately set out to the site but by the time he got there, the Bayesian had already sunk, with only cushions, wood and other items from the superyacht floating in the water.

“But for the rest, we didn’t find anyone,” he said from the port hours later. He said that he immediately alerted the coast guard and stayed on site for three hours, but didn't find any survivors. “I think they are inside, all the missing people.”

He said he had been up early to check the weather to see if he could go fishing, and surmised that a sudden waterspout had struck the yacht.

“It could be that the mast broke, or the anchor at the prow pulled it, I don’t know,” he said.

Cocina said the crew and passengers hailed from a variety of countries: In addition to Britain and the United States, passengers and crew were from Antigua, France, Germany, Ireland, Myanmar, the Netherlands, New Zealand and Spain, he said.

Among the dead and missing, four were British, two were American, and one was a man with dual citizenship from Canada and Antigua, according to Luciano Pischedda, the Italian Coast Guard official overseeing the rescue operations.

The UK Marine Accident Investigation Branch is deploying a team of four inspectors to Italy to conduct a preliminary assessment. The Foreign Commonwealth and Development office said it was “providing consular support to a number of British nationals and their families.”

Dutch foreign ministry spokesperson Casper Soetekouw said the lone Dutch citizen on board, a man, had been rescued and was not in life-threatening condition.

Lynch, once hailed as Britain’s king of technology, was cleared in June of fraud and conspiracy charges related to Hewlett Packard’s $11 billion takeover of his company, Autonomy Corp.

The not-guilty verdicts followed an 11-week criminal trial in San Francisco that delved into the history of HP’s  2011 acquisition  of Autonomy, a business software firm founded by Lynch.

The  fraud accusations  represented a dramatic turn in the fortunes of an entrepreneur once described as the Bill Gates of Britain — a title he seemed to live up to when he netted an $800 million from the Autonomy sale.

The acquittal vindicated Lynch, who had vehemently denied wrong doing and portrayed HP as a technological train wreck.

“I’m looking forward to returning the UK and getting back to what I love most: my family and innovating in my field,” Lynch said in a statement released after the verdict.

The yacht, built in 2008 by the Italian firm Perini Navi, can accommodate 12 passengers in four double cabins, a triple and the master suite, plus crew accommodations, according to Charter World and Yacht Charters.

The vessel, which previously was named Salute when it flew under a Dutch flag, featured a sleek, minimalist interior of light wood with Japanese accents designed by the French designer Remi Tessier, according to descriptions and photos on the charter sites.

Newly released video captures a luxury superyacht being battered by a violent storm before it suddenly sank off Sicily with 22 people aboard  Monday.

The grainy images obtained by NBC News and other outlets were recorded on closed-circuit television not far from where the Bayesian was anchored,  about a half-mile from the port of Porticello, on Sicily’s northern coast .

The yacht's 250-foot mast, illuminated with lights and lashed by the storm, appears to bend to one side before it finally disappears and is replaced by darkness.

The speed with which a yacht built to handle the roughest seas capsized stunned maritime experts.  

“I can’t remember the last time I read about a vessel going down quickly like that, you know, completely capsizing and going down that quickly, a vessel of that nature, a yacht of that size,” said Stephen Richter  of SAR Marine Consulting.

British tech tycoon Mike Lynch and five of the 22 other people who were aboard the 184-foot vessel remain unaccounted for and are believed to be trapped in the Bayesian’s hull, nearly 170 feet underwater.

Superyachts like the Bayesian, which had been available for charters at a rate of $215,000 a week, are designed to stay afloat even as they are taking on water to give the people aboard a chance to escape, Richter said. 

“Boats of this size, they’re taking passengers on an excursion or a holiday,” Richter said. “They are not going to put them in situations where it may be dangerous or it may be uncomfortable, so this storm that popped up was obviously an anomaly. These vessels that carry passengers, they’re typically very well-maintained, very well-appointed.”

Built by Italian shipbuilder Perini Navi in 2008, the U.K.-registered Bayesian could carry 12 guests and a crew of up to 10, according to online specialist yacht sites. Its nearly 250-foot mast is the tallest aluminum sailing mast in the world,  according to  CharterWorld Luxury Yacht Charters. 

On Tuesday, Italian rescue workers  resumed the search for Lynch  and the five other passengers still missing: Lynch’s 18-year-old daughter, Hannah; Morgan Stanley International Chairman Jonathan Bloomer and his wife; and Clifford Chance lawyer Chris Morvillo and his wife.

“The fear is that the bodies got trapped inside the vessel,” Salvatore Cocina, the head of civil protection in Sicily, told Reuters .

The Bayesian is owned by a firm linked to Lynch’s wife, Angela Bacares, who was one of the 15 people rescued Monday after it capsized.

“It’s extremely rare for a boat of this size to sink,” Richter said.

What’s not rare is the kind of storm that sank it , said Simon Boxall, senior lecturer in oceanography at Britain’s University of Southampton.

“People assume the Mediterranean is this rather calm and passive place that never gets storms and always blue skies,” Boxall said. “In fact, you get some quite horrendous storms that are not uncommon at this time of year.”

The president of Italy’s meteorological society has said Monday’s violent storm may have involved a waterspout, essentially a tornado over water, or a downburst, which occurs more frequently but doesn’t involve the rotation of the air.

Luca Mercalli, president of the Italian Meteorology Society, also said recent temperatures may have been a factor. 

“The sea surface temperature around Sicily was around 30 degrees Celsius [86 Fahrenheit], which is almost 3 degrees more than normal,” Mercalli told Reuters. “This creates an enormous source of energy that contributes to these storms.”

The Mediterranean sailing vacation was designed to be a celebration for Lynch, who two months ago was  acquitted by a San Francisco jury of fraud charges  stemming from the 2011 sale of his software company Autonomy to Hewlett-Packard for $11 billion.

Prosecutors alleged that Lynch, dubbed “Britain’s Bill Gates,” and Autonomy’s vice president for finance, Stephen Chamberlain, had padded the firm’s finances ahead of the sale. Lynch’s lawyers argued that HP was so eager to acquire Autonomy that it failed to  adequately check the books .

Lynch had taken Morvill, who was one of his defense attorneys, on the luxury trip. 

Chamberlain was not on the Bayesian.

In what appears to be a tragic coincidence, a  car struck and killed Chamberlain on Saturday as he was jogging in a village about 68 miles north of London, local police said.

“Steve fought successfully to clear his good name at trial earlier this year, and his good name now lives on through his wonderful family,” Chamberlain’s lawyer, Gary Lincenberg, said in a statement .

Questions for Investigators Trying to Unravel Mystery of Luxury Yacht’s Sinking

The investigators searching for answers about the shipwreck, leaving seven dead, face questions about extreme weather and possible human error or problems with the yacht itself.

More than 180 feet long, with a mast towering about 240 feet and a keel that could be lowered for greater stability, the Bayesian luxury yacht did not, in the eyes of its maker, have the vulnerabilities of a ship that would easily sink.

“It drives me insane,” Giovanni Costantino, the chief executive of the Italian Sea Group, which in 2022 bought the company that made the ship, said after its wreck last week. “Following all the proper procedures, that boat is unsinkable.”

But the $40 million sailing yacht sank within minutes and with fatal results: seven dead, including the British technology billionaire Michael Lynch, his teenage daughter, four of Mr. Lynch’s friends and a member of the crew. Fifteen people, including the captain, escaped on a lifeboat.

Mr. Lynch had invited family, friends and part of his legal team on a cruise in the Mediterranean to celebrate his acquittal in June of fraud charges tied to the sale of his company to the tech giant Hewlett-Packard.

The Italian authorities have opened a manslaughter investigation, searching for answers from the survivors, the manufacturer and the wreck itself. They face a range of questions and possible factors.

An ‘earthquake’ in the sky?

When the Bayesian sank around 4 a.m. on Aug. 19, the waters in its area, about half a mile off the Sicilian port of Porticello, were transformed by an extremely sudden and violent storm, according to fishermen, a captain in the area and meteorologists.

But what kind of storm is still a mystery, compounded by the fact that a sailing schooner anchored nearby did not have its own disaster. Also unclear is whether the crew was aware that the Italian authorities had issued general warnings about bad weather the night before.

Karsten Börner, the captain of the nearby passenger ship, said he’d had to steady his ship during “really violent” winds . During the storm, he said, the Bayesian seemed to disappear behind his ship.

Severe lightning and strong gusts were registered by the Italian Air Force’s Center for Aerospace Meteorology and Climatology, according to Attilio Di Diodato, its director. “It was very intense and brief in duration,” he said.

The yacht, he said, had most likely been hit by a fierce downburst — a blast of powerful wind surging down during a thunderstorm. His agency put out rough-sea warnings the previous evening, alerting sailors about possible storms.

Locals have said the winds “felt like an earthquake.” A fisherman in Porticello said that he had seen a flare go off in the early-morning hours. His brother ventured to the site once the weather had calmed about 20 minutes later, he said, finding only floating cushions.

The Italian authorities have so far declined to say whether investigators had seen any structural damage to the hull or other parts of the ship.

Open hatches or doors?

The boat executive, Mr. Costantino, has argued that the Bayesian was an extremely safe vessel that could list even to 75 degrees without capsizing. His company, the Italian Sea Group, in 2022 bought the yacht’s manufacturer, Perini Navi, which launched the ship in 2008.

Mr. Costantino said that if some of the hatches on the side and in the stern, or some of the deck doors, had been open, the boat could have taken on water and sunk. Standard procedure in such storms, he said, would be to switch on the engine, lift the anchor and turn the boat into the wind, lowering the keel for extra stability, closing doors and gathering the guests in the main hall inside the deck.

At a news conference on Saturday, almost a week after the sinking, investigators said the yacht had sunk at an angle , with its stern — where the heavy engine was — having gone down first. The wreck was found lying on its right side at the bottom of a bay, about 165 feet deep.

Water pouring into open hatches or doors could have contributed to the sinking, experts say, but that on its own may not account for the speed at which such a large boat vanished underwater.

Asked about the hatches at the news conference, the authorities declined to comment on whether they had been found open at the wreck.

The authorities have also not specified whether the boat had been anchored, whether it was under power at the time or whether its sails had been unfurled.

A retracted keel?

The Bayesian had a keel — the fin-like structure beneath a boat that can help stabilize it — that could be retracted or extended, according to its manufacturer. On some yachts, keels can be raised to let the large vessel dock in shallower water, and extended downward to help keep a boat level.

But like the hatches, the status of the keel alone may not explain why a large ship sank with such precipitous speed. Investigators have not disclosed what divers may have seen at the wreck, aside from saying divers had faced obstacles like furnishings and electrical wiring in tight quarters. Officials want to raise the wreck to better examine it, a process that may take weeks.

Human error?

Ambrogio Cartosio, the prosecutor in charge of the case, said at the news conference that it was “plausible” crimes had been committed, but that investigators had not zeroed in on any potential suspects.

“There could be responsibilities of the captain only,” he said. “There could be responsibilities of the whole crew. There could be responsibilities of the boat makers. Or there could be responsibilities of those who were in charge of surveilling the boat.”

It remains unclear what kind of emergency training or preparation took place before the disaster, or what kind of coordination there was during it. So far, none of the surviving crew members have made a public statement about what happened the night the ship sank.

Prosecutors said they want to ask more questions of the captain and crew, who have been in a Sicilian hotel with other survivors. They said that neither alcohol nor drug tests had been performed on crew members, and that they have been allowed to leave Italy.

Prosecutors also said they were also investigating why the captain, an experienced sailor, left the sinking boat while some passengers were still on board.

Besides possible manslaughter charges, the authorities are investigating the possibility of a negligently caused shipwreck.

The bodies of five passengers were found in one cabin, on the left side of the yacht, the authorities said. The five were most likely trying to flee to the higher side of the boat and were probably sleeping when the boat started to sink, they said.

When being a part of the Below Deck: Mediterranean cast, their goals include wanting to grow in the yachting industry to become either a Chief Stew or a Bosun. This is the case with Ellie Dubaich from Season 9, who has shown throughout the season how one of her main goals in her career as a stewardess is to become a Chief Stew someday. This is a dream any of them strive for, but Ellie has shown the opposite, as she is not ready for that role whatsoever. Regarding power rankings, Chief Stew is in charge of the interior team and delegates who will be in charge of each section of the boat, whether it is service or cleaning. As the second stew, Ellie is the person that Aesha needs to rely on whenever she is busy and has to delegate some responsibilities, since they are the ones who have more experience.

During the season, Chief Stew Aesha Scott struggled with Ellie and Third Stew Bri Mueller as they have had issues with their jobs and personal lives, both having a crush on deckhand Joe Bradley. With these issues, as a second stew, Ellie needed to put her job first and not bring any of their drama to their work, but she failed to do so as she started to be condescending towards Bri about mistakes she made as a third stew. She has not taken the time to give Bri any constructive criticism to help her grow in the department. Instead, she has tried to throw her under the bus with Aesha and Captain Sandy Yawn . Throughout the season, Bri has also not been the perfect stew, as she has made mistakes during charters, has not taken accountability for her errors, and has pointed fingers at someone else. Besides her mistakes, she has also claimed she has been micromanaged throughout her time on Mustique by Aesha when, in reality, Aesha has not been able to leave her in charge whenever she needs to take a break. Ellie made mistakes and showed her lack of experience throughout the charter season. Ellie has the right formula to become a Chief Stew, but she needs to understand by listening to her superiors who want to help her evolve and be taken down her high horse, on which she believes she has made no mistakes.

Ellie Went Through a Power Trip Against Bri

When viewers first met Ellie Dubaich on Season 9 of Below Deck: Mediterranean , she showed initiative to learn because she loves her work and wants to become a Chief Stew . From her and Bri Mueller, on paper, she also had the most experience, which is why Aesha Scott decided to give her the role of a second stewardess on the boat, as she had also already done a season in the Mustique before Season 9, which gave her more experience on the yacht as well. Becoming the second stewardess meant that Ellie would be the second in command when it came to Aesha taking breaks or if she was away with the guests; another part of her role meant she would be the one to help Aesha to train Bri with her duties, since she was the greenest out of the two of them . What seemed an easy task for Ellie became a bigger problem for Aesha, which almost meant having to fire both .

One of the main reasons the two stews were having issues was because they both had grown a crush on deckhand Joe Bradley, and it did not help that he strung them along, making them take their competition into the love department carryover during their work. Ellie showed that she was going through a power trip when it came to her position, as she started to act condescending towards Bri during their roles and even went on to call her out because she did not have much experience. Bri stood up for herself and told Ellie she felt she was belittling her , which triggered Ellie to say, "Your lack of experience is in you not being aware of how a boat works." This statement towards Bri should not have been told as Bri had already been dealing with the stress of feeling she was not good enough for her job, and now she had one of her coworkers accentuate that by saying it out loud. If Ellie wants to become a Chief Stew, she should learn different ways to express concerns so that she doesn't have to bring down everyone and instead find ways to help everyone grow in the department. If 2/3 of the department does not get along, it becomes a recipe for disaster and more work for Chief Stew.

Aesha's Relationship with Ellie Has Taken a Toll

As a Chief Stew, Aesha Scott has to put on many hats since she is the one who has had the most experience in the yachting world, but her doing everyone's job also means that she risks becoming burnt out . This is why Chief Stews need to have second stews who they can rely on whenever they need to take some time apart from the job to recover. This season, though, she has struggled with Ellie. She said she has the experience, but her work has not shown her expertise. During one of the episodes where Aesha needed to take a break, she left Ellie in charge of setting the table and ensuring the guests were always served. Aesha had to stop her break early because Ellie kept asking Bri many questions that should have been easy fixes, and she did not take the time to set the table for the guests' lunch. At that moment , Ellie started feeling she was being micromanaged and that Aesha did not trust her to lead the service alone . After that, Ellie began to make more mistakes and wasn't taking accountability for her errors, like making poor drinks for guests and leaving her phone behind in a guest's cabin when they were not supposed to be on their phones. Aesha decided to call her out on her behavior, and Ellie started feeling attacked instead of taking this as constructive criticism.

This season has taken a toll on Aesha as she has had to work harder on a yacht that requires a team of four stewardesses, and her stews are inexperienced. Luckily, even though the charter season is almost over, she can have a breather as Captain Sandy has recruited a fourth stew to relieve Aesha. What may seem as a positive for the interior team has been taken as a negative by Ellie as she felt threatened in her role, since new stew Carrie O'Neill has more experience than her on paper, which could mean her role as second stew could be taken over. Ellie started questioning Aesha about where Carrie would be in the team as she took over her service role and felt she was being pushed to the side. Aesha explains in her confessional that "If you want to make it as a Chief Stew, the most important part of the job is the guest experience, not her second stews insecurities." Ellie takes things personally, and she doesn't separate her professional role from her problems, which can hinder her from achieving her goal of becoming a Chief Stew. For Ellie to make it into the yachting world, she should be able to listen and take criticism, as that is the only way she will grow professionally.
