This page states the Terms under which you may use this Website. Please read this page carefully. If you do not accept the Terms of Usage stated here, please do not use the Website. Island Routes Caribbean Adventures reserves the right at any time, at our sole discretion; to change or otherwise modify these Terms without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or modified contents.

IMPORTANT: THESE TERMS AND CONDITIONS APPLY IN RELATION TO EXCURSIONS, TOUR OPERATORS, AND OTHER SERVICES FOR YOU AND ANYONE TRAVELING WITH OR THROUGH YOU (COLLECTIVELY AND INDIVIDUALLY "GUEST") AND MAY AFFECT YOUR LEGAL RIGHTS. CONTENTS OF THIS SITE

While we strive to always provide the latest information and details about our product offerings on this Website, information presented here is subject to change and is not guaranteed to be free from errors. Contents of this Website only apply to Tours and Excursions located in the Destinations in which we operate.

All prices listed in this Website are in U.S. Dollars, unless otherwise specified. Promotions listed in this Website can be changed or withdrawn at any time.

CANCELLATION POLICY

Flexible: full refund within a limited period.

For cancellations by Guests, cancellation charges depend on when Island Routes receives notice of the cancellation. Minimum cancellation charges are as follows:

Hotel Guests:

24 hours or less: No Refund

48 hours or less: 50% Cancellation Fee

96 hours or less: 25% Cancellation Fee

96+ hours: Full Refund

Shore Excursions:

96 hours or more: Full Refund

Less than 96 hours: No Refund

G r oup Reservations:

60 days prior to tour date: Full Refund

45 days prior to tour date: 50% Cancellation Fee

30 days prior to tour date: 75% Cancellation fee

Less than 30 days prior to tour date: No Refund

All cancellations of, or changes are subject to applicable restrictions. Island Routes Tours will apply any payments made toward the purchase price against any cancellation charges and will refund any balance remaining after the payment of any charges. In order to receive a refund, if applicable, client must request and receive a cancellation confirmation number. The cancellation charges outlined above are liquidated damages and not a penalty. Holiday periods may be subject to additional cancellation charges. NO REFUNDS OR ADJUSTMENTS WILL BE MADE FOR ANY PORTION OF TOUR OR ATTENDANT SERVICES NOT UTILIZED.

Refund Policy: No refunds or adjustments will be made for any portion of your tour not utilized.

Changes to Reservations: All requested changes to reservations are subject to Island Routes' sole discretion, and any changes must be approved in writing.

Changes are subject to all applicable fees, and charges. Guests wishing to make a change, please call 1.877-768-8370

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of this Web site, you warrant that you will not use this Web site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

PREPAID TOUR & EXCURSION RESERVATIONS

By reserving your tour and excursion, you authorize Island Routes Caribbean Adventures to book reservations for the total reservation price. You agree that your credit card will be charged by Island Routes Caribbean Adventures for the total reservation price.

BANK & CREDIT CARD FEES

Some banks and credit cards impose fees for cross-border transactions. By reserving your tour and excursion on this website, you may see an additional cost/fee appearing on your credit card statement. This fee is solely determined by your Bank and/or Credit Card Company and Island Routes Caribbean Adventures takes no responsibility for these associated costs. If you have any questions about these types of fees applied to your reservation, please contact your bank directly.

Some tours are physically demanding and are not suitable for the infirm, individuals with heart condition, women who are pregnant or the physically challenged. Tour times and dates may vary based on volume or availability. To the exclusion of tours identified at www.islandroutes.com as being owned by Sunisland Routes and/or Island Routes Tours, there exists no relationship of master and servant or of agency between the Operators of tours and either Sunisland Routes and/or Island Routes Tours, or the hotel. Sunisland Routes and/or Island Routes Tours, and the hotel, do not operate the tours, and for these purposes, the Operators of tours are independent contractors. The Operators of tours are solely responsible for their acts and omissions and Sunisland Routes and/or Island Routes Tours, and the hotel, assume no responsibility for such acts and omissions, or for any injury, loss, damage, sickness or accidents sustained on any of the tours offered for sale , including but not limited to any that occur on and/or during the tour, as well as before and after as part of and/or during transport to/from the tour ‐ again, to the exclusion of tours identified as being owned by Sunisland Routes and/or Island Routes Tours. Without any exclusion, however, Sunisland Routes and/or Island Routes Tours, and the hotel, shall not assume any responsibility for injury, loss or damage to any person that voluntarily participates in cliff diving at any location, including but not limited to Dunn's River Falls or Rick's Café, and/or to any person who voluntarily stops as part of and/or during transport to/from a tour at an unintended destination, meaning one that is separate and apart from the scheduled tour and/or destination. Individuals proceeding in such manner assume any and all responsibility and risk, as this is not a recommended activity. Sunisland Routes and/or Island Routes Tours, and the hotel, in addition shall not assume any responsibility for the loss or damage to money, jewelry, clothing or other valuables that have not been tendered to Management for safe keeping. Please note, for your safety, Guest will not be allowed to participate in helicopter tours and/or transfers if they have undertaken any diving exercise within 24hrs prior to departure of said tour/transfer.

LIMITATION OF DAMAGES

Guest HEREBY ACKNOWLEDGES AND AGREES that Sunisland Routes and/or Island Routes Tours, and the hotel, their parent corporation, affiliates, subsidiaries, insurers, directors, officers, employees, successors, assigns, agents or representatives, SHALL NOT BE LIABLE to Guest for liabilities, claims, actions, damages, cost or expense in any circumstances, for: (A) ANY PERSONAL INJURIES OR PROPERTY DAMAGE ARISING OUT OF OR CAUSED BY ANY ACT OR OMISSION ON THE PART OF ANY Guest(s) and/or Operators of tours, excluding tours identified as being owned by Sunisland Routes and/or Island Routes Tours; (B) EMOTIONAL DISTRESS, MENTAL SUFFERING, OR PSYCHOLOGICAL INJURY OF ANY KIND; OR (C) ANY CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES. This specifically includes but is not limited to liabilities, claims, actions, damages, cost or expense ARISING OUT OF OR CAUSED BY food or drink consumed at third party facilities belonging to third party Operators of tours.

SPECIAL REQUESTS

Sunisland Routes and/or Island Routes Tours cannot guarantee that it will satisfy special requests and we are not responsible if such requests are not met.

PERSONS WITH DISABILITIES

Persons with Disabilities: Sunisland Routes and/or Island Routes Tours cannot guarantee that transfer vehicles or tour sites are wheelchair accessible. However, if informed, we will endeavor to make the necessary arrangements. This may however come at an additional cost.

VENUE AND CHOICE OF LAW

ALL CLAIMS WHATSOEVER AGAINST SUNISLAND ROUTES AND/OR ISLAND ROUTES TOURS, ITS AFFILIATES, PARENT COMPANY, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS, ARISING FROM, IN CONNECTION WITH, OR INCIDENTAL TO THE CONTRACT, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS RELATING TO THE FORMATION, INTERPRETATION, CONSTRUCTION, WAIVER, MODIFICATION, PERFORMANCE, DISCHARGE, OR BREACH OF THE CONTRACT, OR THE EXISTENCE, EXTENT, OR BREACH OF ANY FIDUCIARY DUTY, OR ANY DUTY IN TORT OR PURSUANT TO ANY STATUTE, SHALL BE LITIGATED SOLELY AND EXCLUSIVELY IN THE COUNTRY IN WHICH THE EXCURSION AND/OR TOUR IS OPERATED, AND SHALL BE GOVERNED BY THE LAWS OF THE COUNTRY IN WHICH THE EXCURSION AND/OR TOUR IS OPERATED WITHOUT REGARD TO THE CHOICE OF LAW PRINCIPLES THEREOF.

USE OF GUEST'S LIKENESS

The undersigned Guest(s) irrevocably consents to and authorizes the use and reproduction by Sunisland Routes and/or Island Routes, or anyone authorized by Island Routes, of any and all photographic, video and other visual portrayal(s) of the undersigned Guest(s), their child or ward, for any purpose whatsoever, including but not limited to use in magazines, brochures, flyers, television, internet, and websites displays without further reference or compensation. All rights, title and interest therein (including all worldwide copyrights therein) shall be the sole property of Sunisland Routes and/or Island Routes, or anyone authorized by Island Routes, free from any claims by the undersigned Guest(s) and or any person deriving any rights or interest from such Guest, AND each undersigned Guest(s) UNDERSTANDS AND HEREBY KNOWINGLY AND VOLUNTARILY SO AGREES.

COMPLIANCE WITH LOCAL LAW

Guest is responsible for knowing, obeying and complying with the laws and regulations of their destination, and neither Sunisland Routes and/or Island Routes Tours, nor any Tour Supplier, nor the hotel, has any duty to inform or warn Guest about the destination's laws and/or regulations.

This agreement is governed by the laws of Jamaica. You hereby consent to the exclusive jurisdiction and venue of courts in Jamaica, in all disputes arising out of or relating to the use of this Website. Use of this Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Island Routes Caribbean Adventures as a result of this agreement or use of this Web site.

The Tobago Cays is a beautiful yacht charter destination to include while on your Grenadines yacht charter . The Tobago Cays are a national marine park run by the St. Vincent and the Grenadines government full of unbelievable beauty offering incredible scuba and snorkelling opportunities on vividly coloured coral reefs. The pure white beaches, gorgeous bays and stunning diving will provide you with some unforgettable memories on your yacht charter vacation.

The Tobago Cays are an archipelago comprising five small uninhabited islands called Petit Rameau, Petit Bateau, Baradol, Petit Tobac and Jamesby. While the cays are uninhabited, they are surrounded by the three larger inhabited islands of Union Island, Mayreau and Canouan.

Fortunately, the Tobago Cays can only be reached by yacht, providing crewed yacht charters a little piece of paradise all to themselves. The protected Marine Park boasts abundant sea life with green turtles, coral reefs and colourful fish. The water and reef colors are a kaleidoscope of gold, brown, blue, turquoise, and green.

Tobago Cays Yacht Charter attractions

Some of the best attractions around the Tobago Cays are scuba diving sites including Purunia Wreck, a 140ft WWI British gunship which sunk in 1918 just off the western coast of Mayreau, the Mayreau Gardens, an excellent Coral Reef site with teaming fish life and colourful sponges and Horse Shoe Reef, an excellent Coral Reef site with an abundance of fish and coral. If you would prefer to snorkel rom your motor yacht or sailing yacht you could enjoy the Baradal Turtle Sanctuary, a protected area where green and hawksbill turtles can be observed foraging freely. At the Catholic Rock Bird Sanctuary, you can observe Sea bird nesting and roosting colonies using binoculars directly from your charter yacht.

Hiking is also possible on Petit Bateau, James Bay, and Petit Rameau where hiking trails lead you to an abundance of tropical flora and fauna including iguanas and birds. They also provide excellent panoramic views of the Grenadines.

The Tobago Cays is that of dreams, a snorkelers paradise, a sunbathers heaven and a movie makers hit, as Petit Tabac, an isolated beach perfect for a private picnic was the location where the desert island scene in “Pirates of the Caribbean: Curse of the Black Pearl” was filmed.

A quintet of uninhabited, unspoilt Caribbean islands

The chain of stunning jewels that spread 68 miles out from the south of St. Vincent to Grenada are the fabulous Grenadines . The 60 islands or so that make up this archipelago include the beautiful Tobago Cays, which are famed for their beauty and have been spared the negative impact of mass tourism due to the lack of direct air transport access.

For the superyacht traveler looking to relax, unwind and explore as many islands as possible, the quintet of uninhabited cays, namely Petit Rameau, Petit Bateau, Baradal, Petit Tabac and Jamesby, that create the Tobago archipelago are a Caribbean destination not to be missed. As such, mooring here is in high demand so the Vincentian government limits the number of vessels in the marine park to a maximum of 150. Therefore planning ahead to secure a spot over the popular winter charter months is well-advised.

This has also meant that the marine life and surrounding coastlines have been carefully preserved and able to flourish, making up the key event of the Tobago Cays Marine Park. The biodiversity in the region is truly breathtaking and divers can expect to enjoy swimming with species such as majestic eagle ray’s and sea turtles.

There are no hotels, restaurants or public facilities on any of the Tobago Cays, so aside from visiting day trippers, if you choose to anchor here on your charter yacht you will be treated to your own private Caribbean island experience. The islands are often used as backdrops for blockbuster movies such as the Pirates of the Caribbean franchise, and some of the best beaches can be enjoyed on the smallest cay of Jamesby. The second trip was another tiny Island where we enjoyed snorkelling after enjoying delicious on board breakfast followed by lovely lunch. Again the crew were amazing. I couldn't recommend this place and The Octopus yacht enough. Claire was brilliant at organising the trips for us. We would like to say a huge thank you and cant wait to come back."

Mermer Advices

Very popular with tourists, Baradal Island offers many anchorages.  The most beautiful landscapes are to the south of the island. The configuration of the sandbanks changes with the currents, as long as the marine charts cannot adapt to them. This generates each time I return to it a significantly different landscape, in which it is necessary to navigate with care. You can anchor or take buoys for 25€ per night.

I advise you to arrange a trip to Petit Tabac for the day with a local (it is forbidden to anchor there since 2022).  This island is a marine natural park naturel, so its ecosystem is vital for the planet. It has the privilege of being part of coral reefs that represent only 0.2% of the ocean's surface and are home to one-third of the world's marine biodiversity.

Tobago Cays hosts a multitude of marine life and land animals. Although uninhabited by people, there are about 50 kilometers of coral reefs, beaches and sea life to explore in the Tobago Cays Marine Park. Living in the Marine Park are gorgeous birds, turtles, iguanas, lobsters and stingrays. By catamaran, the round trip to the Tobago Cays from the mainland is roughly 6 hours. By speed boat, the round trip takes about 3 hours.

A World Away: Cruising the Tobago Cays

There’s always a feeling of excitement mixed with a twinge of anxiety as the mooring pendant drops, or the anchor is catted, and a voyage begins. What do they say? The thrill in adventure is just this side of terror.

This time, it was the Friday before Easter. Any savvy sailor knows that you never begin a voyage on a Friday, not even on Good Friday.

Our plan was for a quick hop from Bequia down to the Tobago Cays, then to clear customs at Union Island, and then to head to nearby Carriacou. We wanted to visit the shipwrights who still build wooden boats the old way. We would begin our real voyage northward, up through the Lesser Antilles, the following week.

The wind was light as we headed out of Bequia’s Admiralty Bay and motored past Moonhole, an abandoned villa carved into the cliffs along the bay’s southern rampart. We rounded Western Cay with the dinghy tagging along behind and headed south-southwest, aiming for the island of Canouan. This string of islands in St. Vincent and the Grenadines stretches for 30 miles and has a lot going for it. The islands are all within sight of one another, all within an easy beam reach, and each different, with anchorages, communities ashore and great diving. It’s a smaller version of the British Virgin Islands.

I consulted my copy of Chris Doyle’s Guide to the Windward Islands as a lazy swell came from the east, barely noticeable on the calm, flat sea. With the sails rolled up and the autopilot set, the boat’s owner and I settled into the cockpit for the two-hour passage to Canouan.

Lounging there in the cockpit, under the dodger and Bimini top, I found much to like about this 30-year-old yacht. It was quality-built, with a lot of thought put into the design. Handholds were where you wanted them; the push-pit surrounded the cockpit; stout stainless steel rails extended forward to midship; and 30-inch-high lifelines ran forward from there. The decks were uncomplicated. The anchor platform on the bow was well planned. There was a good-size windlass with a chain break. A single bow roller housed the Rocna anchor. There was room on the foredeck to strap down the dinghy offshore.

I was happy to be aboard as Bequia dropped astern and two small islands appeared 2 miles off to port: Petit Nevis and Isle à Quatre. On the horizon, 5 miles farther east, was Mustique, a hideaway for royalty and the jet set. (Neither of us were appropriately attired for a visit.) Ahead, Canouan was visible, and beyond that, the rugged peaks of Union Island, looking like a gateway to Jurassic Park, only 24 miles away.

Canouan was one of the poorest islands in the Caribbean when I anchored there 15 years ago. Then, hotel developers expanded the airport to accommodate private jets. The residents now have a slightly higher standard of living. Grand Bay is the main harbor and anchorage, but we kept going.

Back in 2010, my family and I spent an overnight near here. It was a night to remember. We had anchored in 16 feet of water, off the Tamarind Beach Hotel’s dock near The Moorings charter base. The wind began to whistle down through the valleys. Gusts were heeling our 57-foot ketch. I had 100 feet of chin out on a 70-pound Bruce, but we were creeping ever closer to a catamaran anchored astern.

I got the kids (then 9 and 11) out of bed to help. The spare bow anchor was a 45-pound Danforth on 30 feet of chain and 200 feet of five-eighths nylon rode. While I brought the RIB around to the bow, the kids untied the Danforth and pulled out the chain and rode from below. They lowered the Danforth over the bow rollers as I guided it into the dink and then motored out 100 feet or more, with the kids paying out the line. Eventually, I slipped the anchor over the side—none of that anchor-throwing stuff for me.

Back aboard, we took in the rode until the anchor chain was slack. The kids were too excited to sleep, as was I. Throughout the night, the wind plucked out a tune in the boat’s rigging.

I thought about that memory as my current ride, Striker , rounded Canouan’s west end. We headed for the next small island, Mayreau, 4 miles away. On its northern tip is a perfect little anchorage, Salt Whistle Bay (more of a cove, really). Its palm-fringed beach and scattering of bars and restaurants make it too popular for those looking to get away from the crowd.

We were heading for an even more magical spot in the Tobago Cays. As we approached, I went forward and sat on the pulpit to watch the water change from deep, offshore blue to pale, with the seabed visible 30 feet below. The pale blue nearly changed to white as we approached the beach. Brown patches denoted coral heads and reefs. This was one lovely and lonely piece of the Caribbean, with only an open sea to the horizon in the distance.

It was late March with the season drawing to a close, but there were two powerboats and a dozen or more sailboats anchored. When I had last come through, it was late January with dozens of boats and beaches full of people.

My preference would be to anchor off the beach at Petit St. Vincent, a private resort that’s far from the crowds, yet within a short dinghy ride to excellent snorkeling. We passed Palm Island, with its resort and villas, and ended up in Clifton Harbor. I had been here a few times, including in 2010 after a month in Grenada.

Back then, we had planned to stop at Union Island for the night. While looking for a spot to anchor, a helpful West Indian chap had come along side in his pirogue, inquiring if we needed a mooring.

“How much?” I asked.

“100 EC.” About $60.

“Too much. We’ll anchor. Thank you, though.”

My new friend was persistent, and we settled for about $30.

“Where?” I asked.

“Follow me.”

He led us to a mooring right in front of the yacht club’s pier. How convenient. I gave him the fee, thanked him, and off he went in his colorful fishing boat. My family climbed into our RIB and went ashore to clear in.

Back on board that afternoon, as I was settling in with a rum and tonic, a day-charter catamaran approached with a woman on the bow. She shouted for us to get off the mooring. My kids ran forward to drop our mooring line as I started the engine, and we circled the harbor, searching for a spot to anchor. By the time our boat was secure, I was fuming.

I spied the pirogue tied to the fishermen’s dock, jumped into our RIB and sped ashore.

“I think he’s at his mother’s place,” an elderly chap told me. “Here, Bert will take you.”

I climbed into a nearby taxi. Off we went—first to his mother’s house, then to his wife’s, then to his girlfriend’s and, finally, back to the pier. My “friend” was waiting. He handed me a $100 EC bill. 

“You got change?” he asked. 

I ignored him and headed for my dinghy. He followed. We climbed into our respective boats. He circled our sailboat. My kids hid behind the staysail bag on the foredeck while I argued the taxi fare, the illegal mooring rental, and the unfairness of it all.

After a while, he realized I wasn’t going to give him the money. He left. I lay awake in the cockpit most of the night, fearing retaliation.

But back to today. 

This time, as we passed the harbor entrance buoy, a pirogue with two teenage boys roared up along the side. The taller boy at the engine yelled: “Do you want a mooring?”

“How much?”

“For you, I give you a discount. Usually $150EC. Today, it’s $100.”

“Too much,” I replied.

He lowered his price.

“Done. Now where?”

They led us to a sorry-looking buoy with an encrusted pendant. We passed one of our lines through the eye of the foul-looking thing. I paid the boys and they took off.

Not trusting the mooring, I donned a mask and snorkel. I swam down the mooring line to the bottom, where it disappeared into the mud. It looked as if it had been there for a century.

We dinghied ashore, tied up at the yacht club, and walk into town, through a bazaar of colorful awnings, umbrellas and tents above everything from jewelry, bikinis and vegetables to artwork and fruit.

We couldn’t resist the two-story Tipsy Turtle. We tucked into a booth on the upstairs porch, ordered rum punches, and surveyed the scene below.  

Tomorrow, we would hop over to Carriacou and clear in.

We could see it from where we sat—only half a day from Bequia, yet in another world.

The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
