Captain, 2 crew members from Mike Lynch's family yacht reportedly under investigation over sinking off Italy

Rome — The engineer and a sailor from the crew of the luxury superyacht that sank off the coast of Sicily , killing British tech entrepreneur Mike Lynch and his 18-year-old daughter along with five other people, have been placed under investigation by Italian prosecutors along with the captain of the vessel, according to the Reuters and ANSA news agencies. CBS News could not immediately reach the prosecutors or lawyers for the Bayesian yacht's crew members to confirm the development, which comes about a week and a half after the vessel capsized on Aug. 19.

Engineer Tim Parker Eaton and sailor Matthew Griffiths, who was on night watch duty when the incident occurred, were reportedly placed under formal investigation for possible manslaughter and culpable shipwreck a few days after the 184-foot Bayesian yacht's captain, James Cutler, whose lawyers have confirmed that he's a subject of the probe.

After meeting with prosecutors for several days, Cutler, a 51-year-old New Zealander, has declined to answer any further questions, his lawyer said Wednesday.

"The captain exercised his right to remain silent for two fundamental reasons," attorney Giovanni Rizzuti told reporters. "First, he's very worn out. Second, we were appointed only on Monday and for a thorough and correct defense case, we need to acquire a set of data that at the moment we don't have."

Lynch and his daughter Hannah, 18, were among the passengers and one crew members who died when the superyacht sank rapidly during a violent storm in the pre-dawn hours of Aug. 19. The capsize of the high-tech vessel quickly raised questions, as another sailboat that had been anchored nearby off the coast of Palermo made it through the storm unscathed.  

Fifteen people, including Lynch's wife Angela Bacares, escaped to a life raft and were rescued by another boat that had been in the vicinity.

According to reports by Italian media, investigators are looking into whether the engineer, Eaton, might have neglected to activate security systems designed to automatically close all the hatches on the vessel, leaving the engine room to flood and possibly causing a power outage and the subsequent rapid flooding of the entire yacht.

Under Italian law, being placed under investigation does not necessarily mean formal charges will follow. 

During a press conference on Saturday, prosecutors said the investigation would require the wreck of the Bayesian to be salvaged from the seabed, where it currently sits at a depth of about 160 feet. 

Chief prosecutor Ambrogio Cartosio said his team would work to determine whether the captain, other crew members, or the yacht's manufacturers bear any responsibility for the sinking.

Goldman Sachs has sold the yacht it seized from entrepreneur William Kallop for $27.5 million – a 30% discount on its $39.9 million asking price.

On 15 July, Goldman Sachs seized the 66-metre superyacht S/Y Natita after Kallop defaulted on a $32 million loan he borrowed from the bank in 2014, for which it was used as collateral. The loan financed the yacht’s purchase and was set to mature in December 2016, later extended to March 2017. Kallop stopped making payments in November 2016.

Goldman Sachs appointed Burgess as the central agent to sell the yacht. Natita was sold on to a buyer in Malta for $27.5 million – the buyer was represented by KK Superyachts as the purchasers sub-listed broker.

While this is a substantial drop-off from its asking price, the sale does cover most of the cash that Kallop owes to the bank. When he stopped making payments, $28.4 million was left outstanding.

The yacht as built by Oceanco in 2005 as a custom design for Usmanov. She sits at 66 metres and was a collaboration between Oceanco and Kusch yachts. The interior was designed by Alberto Pinto.

The yacht was first sold to Kallop for €59.9 million in 2010, by Russian billionaire Alisher Usmanov.

The yacht was put back on the market in 2010 for an asking price of €59.9 million, which Kallop paid when he bought it.

Wealth Loans

Financing luxury assets like yachts and jets is generally not the safest investment. Yachts especially decrease in value substantially from user to user. One of the biggest reason banks finance a yacht is to keep hold of or get new high wealth individuals and customers. Most of the time they can pay back the asset without any trouble and banks will be happier to extend the loan than seize the asset.

A bank will need to be pushed to seize the yacht. Firstly, it costs a lot to sell a yacht. Whilst the yacht is on the market, you have to  store, maintain and service the yacht.

Natita’s maintenance costs equated to $4492.72 per day according to court documents – $1819.38 of which was due to docking expenses. As of 30 September, the yacht cost Goldman Sachs $437,803.32 to store.

Also, banks want to keep their customers, they will not descend immediately on them when they miss payments. They will generally try to work with a customer to rearrange a deal.

Oceanco Sunray

Natita is not the only Oceanco yacht to be caught up in a financing scandal involving Goldman Sachs.

The 86-metre Oceanco Sunrays might be seized by New York hedge fund Davidson Kempner Capital Management, according to Bloomberg. It looks to secure $200 million that it is owed from a New York legal ruling. A subsidiary of the hedge fund, Barclays, Credit Suisse and Goldman Sachs provided a loan of $450 million to Essar Global Fund, an investment vehicle controlled by Shashikant and Ravikant Ruia, Bloomberg reported.

Davidson Kempner Capital has already seized the Ruia family’s private B737-700 to help secure the loan. However, $175 million is still outstanding.

PALERMO: Initial examinations of four of the people killed when British tech tycoon Mike Lynch's family yacht sank off Sicily last month indicated they had died of suffocation as oxygen ran out on the stricken vessel, judicial sources said on Thursday (Sep 5).

Lynch, his daughter Hannah, an onboard cook and four guests died when the Bayesian, a British flagged 56-metre superyacht, sank during a severe and sudden weather event off the port of Porticello, near Palermo, on Aug 19.

First results from autopsies on four of the victims - Morgan Stanley International chairman Jonathan Bloomer, his wife Judith, lawyer Chris Morvillo and his wife Neda - suggested that they died from suffocation, having been trapped on the ship.

More forensic tests were ordered, with results expected in the coming weeks, the sources said.

The autopsies on cook Recaldo Thomas and Mike Lynch were expected to be conducted on Friday, with Hannah Lynch due to follow on Saturday.

The bodies of the dead, except for the cook, were found in the cabins on the left-hand side of the boat, where the passengers may have tried to search for remaining bubbles of air, the head of Palermo's Fire Brigade said last month.

James Cutfield, the ship captain, and crew members Tim Parker Eaton and Matthew Griffiths have been placed under investigation by the Italian authorities for potential manslaughter and shipwreck .

Being investigated does not imply guilt and does not mean formal charges will follow.

Griffiths, who was on watch duty on the night of the disaster, has told investigators that the crew members did everything they could to save those on board the Bayesian, according to comments reported by Italian news agency Ansa last week.

The sinking has puzzled naval experts, who said a vessel like the Bayesian, built by Perini, a high-end yacht manufacturer owned by The Italian Sea Group, should have withstood the storm and, in any case, should not have sunk as quickly as it did.

For those Indians — and those with desi roots — who are counted among the world’s wealthy, island hopping in Europe aboard their customised 200-feet yacht or taking off in their bespoke jet across the continent are but a way of putting a monogram on their commute. Take a look at the rides of the jet set:

Lakshmi Mittal’s Amevi

In 2014, this London-based billionaire was spotted relaxing on the Greek island of Mykonos, dressed casually in a white T-shirt and baggy shorts. A newspaper report speculated that while Mittal lounged on the beach alongside other tourists, his 262-feet-long yacht Amevi was parked in the waters nearby. Some amenities on board: Sun decks, a heated swimming pool, a cinema, a gym, a massage room, a hairdressing salon as well as a unique, stabilised pool table to name a few.

Mukesh Ambani’s Boeing Business Jet

More than a decade ago, it was reported that Ambani gifted his wife, Nita, a private jet on her 44th birthday. It was said at the time that this jet was “custom-fitted with an office and a cabin with game consoles, music systems, satellite television and wireless communication. It also has a master bedroom, a bathroom with a range of showers and a bar with mood lighting”. As his personal ride, Ambani reportedly favours a Boeing Business Jet. “Most often, they want access to the same amenities in the air.” That’s how the airplane maker describes their customer’s requirement, a.k.a, a flying home, as that’s what’s wanted.

Ravi Ruia’s Sunrays

“The ultimate guest and owner’s yacht.” That’s how the captain of Sunrays, delivered in March 2010 describes it. According to a description of the yacht available on the Oceanco’s website, “The upper deck is given over to the owner’s suite and an adjacent VIP suite that can be combined to create one expansive living area. Both suites have fold-down sea balconies. The owner’s exterior foredeck hosts a whirlpool and sunbathing area. The remainder of the yacht’s accommodations for up to 16 guests is on the main deck with one VIP stateroom and four guest cabins.” The large dining room can be converted into a video conference room with the optional use of the adjacent library. Foldable sea balconies provide guests unimpeded views while dining.

Kumar Mangalam Birla’s Cessna Citation

A blog published by an apparel brand, owned by the Aditya Birla Group, documented the private jets of India’s rich and famous. The listicle included the jets owned by Birla, the Group’s chairman. It said, “Few people know that this sharp, business-minded entrepreneur also has a sweet tooth, when it comes to sweet flying machines, with his Gulf Stream (G100) and Cessna Citation...It’s believed that Citations are the world’s most established, well-liked and most trusted fleet of business jets. The jet has high-tech design of pilot-friendly flight decks and luxury cabin interiors. Birla is often spotted taking a ride in his luxurious aircrafts.”

Sunil Vaswani’s Platinum

This Dubai-based billionaire’s yacht is apparently a fixture in the Mediterranean and was even spotted at the French Riviera around the time that the Cannes Film Festival was held this year, with others in the list for company. Vaswani, who is considered to be one of the richest Indians in the Gulf Cooperation Council (GCC) countries, was once described as he “who lives on multiple continents and sails the Mediterranean each summer in an all-purpose luxury yacht”. The logo of the Stallion Group, which he heads, adorns the yacht.

Ratan Tata’s Dassault Falcon 2000

Tata’s love for aviation is an open secret. But he is perhaps one of the handful of billionaires in the world who not only owns a private jet, but even flies one. “A lot of people know that Ratan Tata owns a Dassault Falcon 2000 private jet but, what they do not know is that since Tata is a trained pilot, he even flies his own private jet and other jets owned by the Tata group,” said an earlier report.

Reuben Brothers’ Siren

“While watching the boat slowly taking shape in Rendsburg, we suddenly became aware of how seductive and mysterious she seemed. We just knew then that we had to call her SIREN and we are absolutely delighted with the result.” That’s the quote attributed to the owner of the 241 feet-long Siren, on the website of Nobiskrug, the German company that built the yacht. Presumably the owner quoted in question is either David Reuben or his brother Simon. Commonly referred to as the Reuben Brothers, they trace their roots back to Mumbai, and are counted among the UK’s richest individuals. Theirs is an award-winning superyacht with a foldable helicopter platform, that can double up as “a sundeck, a dance floor or a stage”.

Adar Poonawalla’s Gulfstream G550

Earlier this year, this scion became the first Indian to take delivery of a fully customised, ACH145 helicopter by Airbus. While his new ride, with a seating capacity of eight is great for covering relatively shorter distances, his Gulfstream G550 aircraft is reportedly his transportation of choice for long-haul journeys. In an earlier interview, Poonawalla had said, “With a 13-hour range, it (his jet) can take me to anywhere in the world with a single halt.” The report further added, “The plane can also come in handy when he (Poonawalla) craves continental food and in case he wants to fly in Michelin star chefs to cook for his friends and him.”
