We specialize in the acquisition or sale of boats outside of Canada. We are familiar with this type of transaction as more than half of our transactions are done outside of Canada.

In addition, we have on-site resources with respect to the Florida market.

Our approach is professional, we always advise our clients to proceed to a thorough verification of the property titles before any acquisition. We work in collaboration with a law firm specialized in maritime law for all our transactions whether the boat is in Canada or abroad.

Our Approach

Given the clear abundance of boats south of the border or overseas compared to here in Canada, it is very frequent that we represent clients for an acquisition outside of Canada. We handle from negotiation, drafting of the purchase offer, assisting in the selection of marine surveyors, final negotiation or complete withdrawal without any penalty (full refund of the deposit) and finally closing the transaction.

Europe and Asia have their own particularities as the boats have an electrical configuration that is different from here in North America without forgetting the EPA norms and the type of display of the monitors and screens. It is therefore, necessary to have a particular approach if you want a fully operational boat when you return to North America.

Also, if you plan to move your boat to Canada (new or used), we take care of the procedures including an assessment of the yacht for customs purposes. We have the expertise for full assistance with an import or export. In addition, we offer you full assistance in transporting the boat from point A to point B.

Canadian among 6 people missing as yacht sinks off Sicilian coast, Italian Coast Guard says

One man died and six people were missing after a luxury yacht was struck by an unexpectedly violent storm and sank off the Sicilian capital Palermo, the Italian Coast Guard said on Monday.

The 56-metre-long sailboat, which was British registered, sank with 22 people on board shortly before sunrise near the port of Porticello, the coast guard said in a statement. The incident occurred when a tornado above the water known as a waterspout struck the area overnight.

The missing people were of British, American and Canadian nationality, the coast guard said.

The wind was very strong. Bad weather was expected, but not of this magnitude, a coast guard official in Palermo told Reuters.

Eight of the 15 people rescued, including a one-year-old child, were transferred to local hospitals. All were in a stable condition, local media reported.

The captain of a nearby boat told Reuters that when the storm hit he turned the engine on to keep control of the vessel and avoid a collision with the Bayesian.

We managed to keep the ship in position, and after the storm was over we noticed that the ship behind us was gone, Karsten Borner told journalists.

He said that his crew then found some of the survivors on a life raft, including three who were seriously injured, and took them on board before the coast guard picked them up.

British tech leader Lynch missing

The coast guard named the yacht as the Bayesian, built by Italian shipbuilder Perini in 2008.

The luxury ship has an aluminum hull and can carry 12 guests and a crew of up to 10, according to online specialist yacht sites.

Twelve passengers, among them were Canadian, and ten crew members were on board the yacht.

One of the survivors, identified as Charlotte Emsley, said she had momentarily lost hold of her one-year-old daughter, Sofia, in the water, but then managed to hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported, quoting the mother. The father, James Emsley, also survived, said Salvo Cocina of Sicily's civil protection agency

Cocina said the vessel belonged to British tech magnate Mike Lynch, who is among the missing. Angela Bacares, Lynch's wife, was among those rescued, though it wasn't immediately clear if she required hospital treatment.

Lynch, aged 59, is one of Britain's best-known tech entrepreneurs. He built the country's largest software firm, Autonomy, from his groundbreaking research at Cambridge University. He sold the firm to HP in a multibillion-dollar deal in 2011, before the transaction unravelled spectacularly following the acquisition, with the U.S. tech giant accusing him of fraud.

Lynch spent much of the last decade in court defending his name. He was acquitted by a jury in San Francisco in June, after he spent more than a year living effectively under house arrest.

Lynch's PhD thesis and the software that made his fortune was based on Bayesian mathematical theory.

Heavy rains in recent days

The boat left the Sicilian port of Milazzo on Aug. 14 and was last tracked east of Palermo on Sunday evening, with a navigation status of at anchor, according to vessel tracking app Vesselfinder.

A U.K. foreign ministry spokesperson said British officials were in contact with local authorities over the incident and were ready to provide consular support for Britons who were affected.

Storms and heavy rainfall have swept down Italy in recent days — with floods and landslides causing major damage in the north of the country — after weeks of scorching heat.

The coast guard said the boat had been found at a depth of 49 metres and that divers were inspecting the wreck. Prosecutors in the nearby town of Termini Imerese have opened an investigation to look into what had gone wrong.

Today, the Minister of Transport, Pablo Rodriguez, announced that Transport Canada has taken unprecedented action to put an end to serious violations of the Canada Shipping Act, 2001 concerning unlicensed passenger vessels. This action underscores Transport Canada’s commitment to enforcing marine safety and protecting Canadians.

Keeping Canadians safe is Transport Canada’s top priority.

In Canada, all vessels that provide a paid service to carry passengers must be registered as passenger vessels and meet applicable safety requirements. Furthermore, vessels carrying passengers in non-compliance with the Canada Shipping Act, 2001 may be subject to an Administrative Monetary Penalty of up to $250,000 related to safety deficiencies.

Transport Canada is aware of the rising trend in pleasure craft operators offering transportation to paying passengers without first registering their vessel as a passenger vessel and ensuring they comply with applicable safety requirements. This is why Transport Canada has increased its level of oversight activity by allocating additional resources to enhance the monitoring of these activities. Transport Canada is also conducting outreach to ensure vessel owners are aware of their obligations.

As a result of this recent increase in activity, the department recently took the following action:

On August 3, 2024, Transport Canada seized the JAG vessel in Boucherville, Québec. The vessel was found to be in non-compliance with several key requirements of the Canada Shipping Act, 2001, including a lack of firefighting, fire detection, fire protection, and life-saving equipment, as well as the absence of lifejackets and certification. Despite repeated warnings and opportunities to correct these issues, the vessel’s owner failed to meet the necessary safety and operational standards.
In addition to the seizure of the JAG , a number of other vessels have been detained through recent oversight efforts while their non-compliances are resolved.

Transport Canada will continue to rigorously enforce all applicable laws and regulations to ensure the safety of all Canadians. We remind all vessel owners and operators to follow the rules and maintain the standards required by law. Similarly, we invite all customers to request a copy of the vessel’s safety certificate from the operator before they embark on a vessel.

All vessels carrying passengers for remuneration must be registered as passenger vessels. A duly registered vessel obtains an official number from Transport Canada. This number can be either a series of 6 digits (example: 876543), or a 5-digit number preceded by the letter C and ending with the province code (example: C12345QC). Prosecutors probe captain of superyacht that sank off Sicily, lawyer says

Prosecutors in Italy are investigating the captain of a superyacht that sank during a storm off Sicily last week, killing seven people, on possible charges including manslaughter, his lawyer said Monday.

James Cutfield, the 51-year-old New Zealand national who was captain of the Bayesian, was among 15 survivors of the Aug. 19 sinking that killed British tech magnate Mike Lynch, his daughter Hannah and five others.

Cutfield is being investigated for possible manslaughter and culpable shipwreck, said lawyer Aldo Mordiglia, one of two attorneys appointed for the captain's defense.

Mordiglia said Cutfield, who already has been questioned, would be questioned again by prosecutors on Tuesday. He declined to discuss the strategy for the defense.

Under Italian laws, being under investigation doesn't imply any guilt, and doesn't necessarily lead to criminal charges.

On Saturday, chief prosecutor Ambrogio Cartosio confirmed that an investigation had been launched. He said his team would consider each possible element of responsibility including those of the captain, the crew, individuals in charge of supervision and the yacht's manufacturer.

The 56-metre (184-foot) British-flagged luxury yacht went down near the Mediterranean island in southern Italy. Investigators are focusing on how a sailing vessel deemed "unsinkable" by its manufacturer, Italian shipyard Perini Navi, sank while a nearby sailboat remained largely unscathed.

Prosecutors said the event was "extremely rapid" and could have been a "downburst" -- a localized, powerful wind that descends from a thunderstorm and spreads out rapidly upon hitting the ground.

The crew was saved, except for the chef, while six passengers were trapped in the hull.

Vincenzo Zagarola, of the Italian Coastguard, said the search for Hannah was not "easy or quick", comparing the sunken yacht to an "18-storey building full of water".

The bodies of all six missing passengers have now been brought to shore in the small fishing village of Porticello, around 11 miles from the Sicilian capital of Palermo.

Of the 22 passengers and crew on board, 15 - including Mr Lynch's wife, Angela Bacares - were rescued after escaping on to a lifeboat.

The body of Canadian-Antiguan national Recaldo Thomas, who was working as a chef on the superyacht, was recovered at the scene of the sinking on Monday.

The boat trip was a celebration of Mr Lynch's acquittal in a fraud case in the US.

The businessman, who founded software giant Autonomy in 1996, was cleared in June of carrying out a massive fraud relating to its 11 billion dollar (£8.64 billion) sale to US company Hewlett Packard.

On Friday, 18-year-old Hannah became the final missing passenger to be recovered from the wreckage of the Bayesian superyacht.

The discovery comes as unconfirmed reports in the Italian media have said that prosecutors are set to announce a manslaughter investigation into the incident.

The pair, alongside Morgan Stanley International bank chairman Jonathan Bloomer, his wife Judy Bloomer, Clifford Chance lawyer Chris Morvillo and his wife Neda Morvillo were lost when the yacht sank at around 5am local time on Monday.

In a statement, Mike and Hannah's family said: "The Lynch family is devastated, in shock and is being comforted and supported by family and friends.

"Their thoughts are with everyone affected by the tragedy. They would like to sincerely thank the Italian coastguard, emergency services and all those who helped in the rescue.

The search efforts inside the sunken superyacht Bayesian are progressing at an extremely slow pace, according to fire service spokesman Luca Cari.

In a statement to Sky News, Cari highlighted the challenges faced by the specialist teams, saying: "It's very difficult to move inside the wreckage."

Illustrating the painstaking nature of the operation, he added: "Moving just one metre can take up to 24 hours."

Raising Bayesian 'will cost 15 million euros and take up to eight weeks'

Nick Sloane, renowned for leading the Costa Concordia salvage operation in 2012, saysraising the Bayesian superyacht from the seabed off Sicility would cost approximately 15 million euros and take between six to eight weeks.

Sloane outlined the complex operation, whichwould require about 40 specialised divers and a large platform towed to the site.

A massive crane would then be used to lift the yacht, but with extreme caution. "If the yacht is pulled up too quickly it could buckle and breakup under the huge pressure of seawater inside it," Sloane explained.

The plan would involve removing the yacht's75-metre high mast before attempting to lift the vessel.

Sloane told La Repubblica newspaper: "I would say it would cost up to 15 million euros but possibly you could do it for a bit less."

Regarding the timeline, he added, "The recovery operation would take six to eight weeks. It could be completed before the second half of October."

Search operations continue, rescue service says

Italy's fire and rescue service has announced that the search for the last missing person from the superyacht disaster is still underway.

In a recent tweet, they confirmed that underwater search operations have resumed, describing the ongoing efforts as "long and delicate."

The service also shared images of rescue teams on boats, gearing up for another round of dives in their tireless pursuit to locate the final missing individual.

100-Year-Old Sailing Ship Uncovered by Flash Flooding on Nova Scotia Beach

Canada’s East Coast is a rough place to sail . Over the centuries, many a ship has met its end in the area , and heavy rains recently exposed a sailing ship that has been hidden for over a century.

Summerville, Nova Scotia is a tiny little town. The water off its coast is connected to the Bay of Fundy — a place with some of the biggest tide swings in the world — and the beach completely disappears under nearly 50 feet of water on a high tide.

A few months ago, however, flash flooding pushed a huge amount of sand off the beach, and one of three abandoned vessels became visible at low tide.

“Most people thought that was the wharf, but they didn’t know there was three ships buried in the sand,” Wilfred Ogilvie told the Global News .

According to reports, the ships were visible until sometime in the ’70s.

“They even had a big bunkhouse here because between the (gypsum) quarry and the docks and everything that was here,” Ogilvie remembered. “There was close to 100 men used to work here.”

Ogilvie said that the boat that was uncovered is likely the Hamburg, “a three-masted wooden vessel with square sails built in nearby Hantsport and launched in 1886.”

When the Hamburg was built, ship nails were made from wood.

“They didn’t use much steel like bolts and things. In those days everything was wood, of course,” Ogilvie explained.

Once the steam engine was invented, though, the Hamburg and her sails were abandoned at the wharf where wrecked ships were kept. That wharf burned down in 1936, but the wrecks remained there.

“And for years they sat there and probably sunk pretty well every day,” Ogilvie said. “And then the gravel started building in around them, and finding their little holes, and (they) were pretty well buried as we’ve seen here today.”
